tears in heaven

I wish to revisit my notes under this label from time to time. Practise without tears.

When taking up a new case you mentally formalise the getting-up, the bundle of documents, issues of admissibility of these documents, burden of proving, how many witnesses to call, ikatan pliding, issues to be tried and from there, work backwards. Ideally you should have the case laws in support of your case beforehand, in the file, and accommodate around two weeks to do the research work; newly decided cases, cases from other jurisdictions. Keep a mental note  of issues you need the answer to, so that you can check the answers when you bump into those walking legal encyclopaedia. A good way to create rapport too !

Discuss with your client the strength and weakness of his case. Be frank with him. Let him know beforehand. Explain the hurdles. Explain your strategy. Explain about the issues of costs, who to bear, in what situation. Explain your bill structure. Bill him in stages. Allow for contingencies, and explain beforehand.

You have Allah with you all along. He's up there watching. Honour your words.



Despite all the effort, when things do not work out, pray. That's the ultimate test. Pray ! You still have Him.
